The Defense Line: Maryland Court of Special Appeals Affirms Trial Court’s Decision that the Improper and Untimely Designation of Experts Results in Summary Judgment

The article discusses a recently published decision by the Court of Special Appeals of Maryland affirming a grant of summary judgment in favor of Kramon & Graham's client, CSX Transportation, Inc. The authors call out the importance of the ruling as a "good reminder that expert disclosures must provide 'the substance' of the experts' opinions and findings, not just 'the general subject matter' of their opinions." They caution that it is of "paramount importance that parties carefully evaluate their experts' opinions and their factual basis before the experts' depositions, as the trial court may not be inclined to provide additional time to designate or depose a new expert."
