Wrongful Death Suit Filed by Dave Shuster and Rig Baldwin
On December 23, 2013, Dave Shuster and Rig Baldwin filed a wrongful death lawsuit on behalf of the widow of a highly-respected local businessman who was fatally injured in a catastrophic accident in his back yard in Arnold, Maryland. The lawsuit alleges that the man was killed while operating an inclined elevator system, which ran from the rear of his house at the top of a hill down a long and steep slope to a dock at the bottom of his property along the Severn River. The complaint alleges that the defendants, who performed work on the hillside lift just before the accident, failed to properly service the lift, including its emergency braking system. The complaint further alleges that, as a result of the defendants' failures, the cables suddenly detached from the carriage and the emergency braking system failed to deploy, causing the carriage to roll uncontrollably down the tracks and crash at the bottom of the steep slope. As a result of the injuries he sustained in the accident, the homeowner died the following day. According to the complaint, “[h]ad the defendants properly performed any one of a number of simple tasks for which they were paid, this tragedy would have been avoided.” Substantial monetary damages are sought.
