Victory for Epic as Judge dismisses "Running Man" Fortnite dance lawsuit; Jim Ulwick serves as co-counsel to defense

Kramon & Graham principal Jim Ulwick served as co-counsel to Kirkland & Ellis on behalf of Epic Games in Brantley et al. v. Epic Games Inc., an intellectual property lawsuit alleging invasion of privacy, unfair competition and unjust enrichment within the Copyright Act. The K&E led defense team prevailed in the United States District Court for the District of Maryland when Judge Paul W. Grimm dismissed the lawsuit with prejudice. The case challenged Epic's use of an "emote" in the popular Fortnite game, and was closely followed by gamers, developers, IP lawyers, and the media, including ESPN, Washington Post, and Bloomberg Law.
