The Yates Memo: What Corporate Counsel Needs to Know
Kramon & Graham principals John Bourgeois and Ezra Gollogly presented “The Yates Memo: What Corporate Counsel Needs to Know,” at the January 2016 ACC-Baltimore Chapter luncheon at Roy's Restaurant.
To deter corporate misconduct, the Department of Justice has implemented new policy initiatives that put individuals at risk of criminal and civil prosecution. First outlined in the Yates Memo, the new strategy is designed to ensure that DOJ attorneys and agents are as effective as possible in making cases against not just corporate entities, but also the individuals through which the corporations act. If corporations want credit for cooperation, the DOJ expects full disclosure about the individuals involved.
The DOJ's new policy initiative has already been implemented. Understanding its impact is critical. In "The Yates Memo: What Corporate Counsel Needs to Know," Kramon & Graham Criminal Defense principals John Bourgeois and Ezra Gollogly provided analysis of the new strategy, and discussed the impact on corporate internal criminal investigations and what it may mean to actual enforcement.
