Steve Klepper co-authors amicus curiae brief for the Maryland State Bar Association

In January, the Maryland State Bar Association filed its first amicus curiae brief in 35 years. Drafted by Kramon & Graham Appellate chair Steve Klepper and J. Bradford McCullogh of Lerch Early & Brewer, co-chairs of the MSBA's Appellate Practice Committee, the brief seeks to "protect core tenets of the attorney-client relationship."

Chavis v. Blibaum Associates, P.A., is a consolidated case currently pending before the Court of Appeals of Maryland. The facts of the case are not in dispute. But ambiguities in the law at the time of the initial court judgment that triggered the appeal have created a situation that threatens to allow attorneys to be punished under the Maryland Consumer Protection Act and the Maryland Consumer Debt Collection Act for advocating on behalf of their clients. As the brief explains, "if advocating for a client on an unsettled area of the law could expose an attorney to liability, it would create an unsustainable conflict between an attorney's professional obligation to advocate zealously on behalf of a client and the fear of potential liability …."
