Kramon & Graham Obtains Summary Judgment for Railroad Client in FELA Case

On behalf of Kramon & Graham's Class I railroad client, firm attorneys Amy E. Askew and Ryan A. Mitchell successfully obtained summary judgment in the Circuit Court for Baltimore City. Seeking substantial monetary damages, the plaintiff filed suit against the firm's client under the Federal Employers' Liability Act alleging that he sustained a career ending injury. The Court granted the client's motion for summary judgment on the grounds that the plaintiff's claim was barred by the doctrine of release.

The plaintiff hotly contested the applicability and scope of the release. The plaintiff also disputed the nature and extent of his past injury, as well as the injury claimed in the current lawsuit. Despite the plaintiff's efforts, Kramon & Graham was successful in convincing the Court that the alleged injury at issue was the same injury cited in 2009 and, therefore, within the scope of the release.
