Getting To Yes – Negotiating Settlement Of Coverage For Longtail Claims

The impediments to settlement are many. Does Qualcomm prevent a policyholder from settling with some but not all insurers? Is the approach in “pro rata” states really any different from negotiations in “all sums” states? When is it better to negotiate a “coverage-in-place” agreement instead of a buy back of the policies? Do reinsurers stifle novel approaches? Does bankruptcy change the calculus? This panel will explore the law implicated by these issues, including recent cases that have made settlement easier or more difficult. Panelists will also speak to their various paths both followed and rejected on their way to settlement.
