Construction Litigation
Experience
Construction Litigation
Construction disputes can be complicated, factually intense, and contentious. They frequently involve disagreements about technical construction issues, differing interpretations of drawings and plans, and divergent views of complicated contractual obligations and performance standards.
When members of the construction industry need legal assistance in defending or resolving construction-related claims, they frequently engage Kramon & Graham. Our clients include regional and national developers, project owners, design professionals, new homebuilders, general contractors, subcontractors, and suppliers in a wide variety of construction disputes and claims. We represent our construction clients in the prosecution and defense of construction and design defect claims, payment claims, mechanics' liens, government contract claims, insurance coverage disputes, delay claims, and Miller Act claims.
Our successful resolution of construction defect claims includes matters involving high-rise fires, structural collapses, geotechnical failures, roof and building envelope issues, condominium defect claims, and collection disputes. Our attorneys handle cases in both federal and Maryland state courts and in arbitration, including cases before the American Arbitration Association and JAMS.
In addition to representing construction clients during litigation, we also assist them in developing contract documents that are designed to minimize litigation risks and enhance the clients' position in the event of litigation. Our litigation attorneys collaborate with our transactional lawyers to prepare contract documents that are customized for our clients' particular business needs and objectives. We have prepared contract documents for a wide variety of construction clients in diverse industries, specialties, and trades.
